Regulations Governing the Product Names and Labeling of
Chocolate
Article 1
These regulations are prescribed in accordance with the provisions of Subparagraph
10 of Paragraph 1 of Article 22 and Paragraph 2 of Article 25 of the Act Governing
Food Safety and Sanitation.
Article 2
The “chocolate” referred to herein is a food preparation of cocoa products mixed with
the addition of sugar, milk or food additives. The food item, in a solid state without
fillings, may be categorized into dark chocolate, milk chocolate and white chocolate.
Article 3
The name of product shall be labeled in accordance with the following provisions:
1. The product name labeled as “dark chocolate” which be use cocoa butter, cocoa
powder and/or cocoa paste as raw material, and it shall contain not less than 35%
total cocoa solids, not less than 18% cocoa butter and not less than 14% fat-free
cocoa solids.
2. The product name labeled as “white chocolate” which be use cocoa butter and milk
powder as raw material, and contain not less than 20% cocoa butter and not less
than 14% milk solids.
3. The product name labeled as” milk chocolate” which be use cocoa butter , cocoa
powder and/or cocoa paste, milk powder as raw material, and contain not less than
25% total cocoa solids, not less than 2.5% fat-free cocoa solids and not less than
12% milk solids.
4. The product name labeled as “chocolate” the raw materials and content should be
follow to three previous.
Article 4
For chocolate that contain vegetable fats in place of cocoa butter but the vegetable
fats content does not exceed the 5% of the total product weight, the text of “the cocoa
butter is mixed with vegetable fats” in Chinese or texts with the same meaning shall be
labeled close to the product name.
Article 5
For chocolate that contain vegetable fats in place of cocoa butter and the vegetable
fats content exceeds 5% of the total product weight, the text of “with cocoa butter
alternative” in Chinese shall be labeled before the product name.
Article 6
The labeling prescribed in the regulations of chocolate shall be in accordance with the
following provisions:
1. Prepackaged chocolates shall be in accordance with the requirements stipulated in
Article 3, Article 4 or Article 5 of the Regulations. The font shall be larger than two
millimeter in length and width.
2. Food vendors with business registration selling bulk chocolate foods shall properly
label the products at the business venue in accordance with Article 3, Article 4 or
Article 5 of the Regulations. The label may be in the form of cards, mark (label) or
notice boards which in turn are either posted, hung, erected (inserted), stuck or
utilized in other ways which are clearly visible. The vendors who choose to label the
products with mark (label) shall make sure the font of the reminder is larger than two
millimeter in length and width. Those who choose to label the products with other
means of communication shall make sure the font of the reminder is larger than two
centimeter in length and width.
